These Terms and Conditions (“Terms”) on this page govern your access to and use of all Services provided by Forge Relations, LLC (“Forge Relations”). If you disagree with any/all these Terms, please do not use any of the Services.
Overview
The Gundies Services are owned and operated by Forge Relations, LLC. By the term “Services”, we refer to any website, application and/or other services, and any associated pages and Content, under the control of Forge Relations.
By the term “Content”, we refer to all content, information and material, including text, software, links, messages, technology, posts, music, video, pictures, sound, graphics, games, emails, and all audio-visual or other material made available on or via the Services, whether uploaded, posted, transmitted, distributed or otherwise made available by us, our agents, licensors, and/or service providers, or by you, and/or other users or third parties.
Whenever we refer to “Forge Relations,” “we”, “us” and “our”, we are referring to Forge Relations, LLC, its group of companies and assigns, and every of our and their respective agents, officers, directors, employees, members, sub-contractors, and representatives.
Whenever we refer to “you” and “your”, we are referring to you the user of the Services.
You understand that we may change the Terms at any time. New Terms become immediately effective upon posting to the Services. Your continued use of the Services shall be deemed as an acceptance of the Terms, as updated. We recommend that you check this page anytime you use the Services.
Accessing our Website
Access to our website is permitted on only a temporary basis. Forge Relations retains the right to withdraw, modify or suspend the website (including any products and/or services accessible on it) without any notice. From time to time, Forge Relations updates its website, and may modify the content at any time without any notice to you. Forge Relations will not be liable in any manner if for any reason our website or any area of it becomes unavailable at any given time.
You’re solely responsible for making every necessary arrangement required to access and view the website and use the Services. You’re solely responsible for ensuring that anyone accessing our website using your internet connection is aware of the Terms here.
The Services
The Gundies are an award ceremony is hosted by us, Forge Relations, LLC, spotlighting influencers & creators within the firearms community, who create unique creative content and provide value to our industry. These are people who create content on Instagram, Facebook, YouTube, TikTok. The Ceremony is set to hold on January 22nd, 2024.
Award Eligibility
To be eligible for awards, you must have created your content for distribution between January 1st 2023 & December 31st 2023. Your Content must have been available through a digital outlet, website, blog, or social media. This means that your Content should have some form of “Online Distribution”, which is the delivery and distribution of Content directly to consumers for online viewing, either on a streaming or download basis, on a website (e.g., YouTube.com, Vimeo.com, personal or company website), or social media platform (e.g., Facebook, Instagram, Snapchat), etc.
The final determination of eligibility is in the sole discretion of Forge Relations.
Nomination Submissions
Nomination application must be submitted by October 31st 2023. All eligible subjects must submit an application for consideration of nomination through our platform.
All information provided must be accurate, valid, and completed in full. Not doing this may make your Submission to be disqualified.
You acknowledge that the names, production details, and other information you provide in the Submission Form may be published if the applicable Eligible Subject becomes an Official Nominee, Award Winner, and/or Audience Choice Award Winner (all as defined below); so please ensure that all details are correct at the time of entry.
Forge Relations reserves the right to extend or shorten the Submission Period.
By making any Submission to Forge Relations, you signify that you (and your parent or legal guardian, if you are a minor in your jurisdiction of residence) have read and agree to these Guidelines, Terms and Conditions, and Privacy Policy.
The Gundie Awards and related services are hosted in the United States at Thegundies.com (the “Website”). If you are located outside of the U.S. and choose to make a Submission on the Website, you consent to having any information you provide to Forge Relations transferred to and processed in the United States, where you understand data protection and other privacy laws may differ from those in your jurisdiction. Information you provide or authorize Forge Relations to access in connection with your Submission is subject to the Privacy Policy.
Official Nominees and Award Winners
Nominee Selection: The Gundie Awards will review all valid Submissions received for each Award to determine and select the official nominees for all Awards as follows (“Official Nominees”):
● For all Awards/Categories, the top 4 nominees in each category are invited to the award ceremony.
● Each Category has one winner.
● Winners are voted upon by the public and win through popular vote.
● Forge Relations maintains full discretion when selecting the final winners.
Voting
There are 15 voting categories, Voting begins December 1st 2023 and closes December 15th 2023. Final winners will be announced publicly on January 22nd 2024 at the award ceremony.
Giveaway Eligibility
To be eligible to win the grand prize trip to Drive Tanks users must vote. Each vote is an entry towards the grand prize. No exchange of money is required to enter this giveaway. Each time a user votes, their votes go into a tally towards the prize and a computer will randomly select the winners upon the close of voting.
There are 15 total winners (1 winner per category). You have to be in the United States to be eligible to win giveaway prizes.
Third-party Links
The Services may include links to some services operated or supplied by third parties such as advertisers and other content providers. Forge Relations has no control over such linked services and is not responsible in any way for their content, legality or functionality. The third parties may collect data or ask for personal information from you; Forge Relations is in no way responsible for either the collection, use or disclosure of any form of information such services may collect from you. Linking to any other services or websites from the Services is at your own risk.
Also, the Services may include certain features, functionality, and/or content that may be hosted, operated or supplied by any third-party service providers, including blogs, public discussion areas, photo and video galleries, auctions, shopping, and payment processing. Such service providers may demand that you accept their additional terms. Your compliance with such additional terms is solely your responsibility and will not affect your continuing obligation to comply with the Terms herein. Forge Relations specifically disclaims any liability regarding the omissions or acts of these third-party service providers.
Any service connected to or otherwise interacting with the Services must not
I. use any the Forge Relations Trademark with no express permission from us;
II. scrape or harvest Content from our website in order to reuse such Content for its own or public use, unless first agreed with us;
III. has any content that could be deemed illegal, controversial, offensive, distasteful or otherwise harmful to the Forge Relations reputation or commercial interests;
IV. create a frame or any other browser or border environment around our Content, unless first agreed with us;
V. violate any intellectual property or other rights of anyone;
VI. infer that the Forge Relations is endorsing or recommending it or its products or services.
Forge Relations retains the right to demand that any link or activity which violates the Terms herein be removed and/or terminated, and to take any other action we believe need to be taken.
Use of the Services by You
You may get and display Content from the Services on a computer screen or any other devices, and store such pages in electronic format on disk (but not on any server or storage device connected to any network) for only your personal, non-commercial use. You may not make commercial or other unauthorized use, publication, performance, re-transmission, caching, distribution, or otherwise, of any Content. You admit to use the Services only for your personal, non-commercial use as well as for lawful purposes, and you admit that your failure to do so may subject you to any form of criminal and civil liability.
In addition, you agree not to use the Services:
I. to violate any applicable local, national or international law, rule or regulation;
II. for anything fraudulent or illegal, or with any fraudulent or illegal purpose or effect;
III. to send, knowingly collect, upload, submit download, use or re-use any material that doesn’t comply with our Copyright Policy;
IV. to transmit, or get the sending of, any unsolicited or unauthorized advertising or promotional material or any other kind of similar solicitation (spam);
V. to knowingly transmit, send, distribute, or upload any data or material that contains viruses, spyware, Trojan horses, keystroke loggers, worms, adware, time-bombs, or any other harmful programs or associated computer code intended to affect adversely the functioning of any computer hardware or software; or
VI. to copy, gather, crawl, mine, harvest, index, scrape, extract, obtain, spider, compile, capture, store, or aggregate any Content, such as images, text, audio, videos, software, data, source or object code, statistics, formulas, algorithms, analysis, registries, repositories, indexes, or any other information available on or via the Services, including by a manual or automated process or otherwise;
Other than connecting to the Forge Relations’ servers by HTTP requests using a web browser, you may not try to have access to the Forge Relations’ servers by any means, such as by using administrator passwords or by claiming to be an administrator during your use of the Services or otherwise.
You agree that you will not disrupt, modify, or interfere with the Services or any related software, hardware and servers, and you agree not to hamper or impede with others’ usage of the Services.
To the magnitude that the Services include a download of specific software such as an app, you accept not to (and not to attempt to or incite others to): (i) use the software and/or app for any purpose other than as clearly authorized by these Terms; or (ii) adapt, copy, change, decompile, disassemble, reverse engineer, distribute, otherwise tamper with, create derivative works based upon, transmit, license, sell, transfer, perform, display, broadcast, stream or otherwise exploit the software and/or app or any area of the software and/or app, unless as clearly authorized in these Terms.
Contributor’s Content
“Contributor’s Content” refers to any Content that you or other users upload, submit, post or make available to or via the Services.
I. is abusive, hateful, obscene, racist, defamatory, discriminatory, invasive of personal privacy or publicity rights, vulgar, sexually offensive, threatening to another user, disruptive to the flow of chat or in our reasonable opinion, illegal, or otherwise objectionable.
II. impersonates anyone, specifies falsely that you are an employee or a representative of Forge Relations or business partners.
III. infringes third party rights (including trademark, copyright, trade secret or any personal or proprietary rights, or confidentiality)
IV. promotes or supports any illegal activity including hacking, terrorism, drug-taking, cracking or distribution of false software.
V. has any advertising, promotional or commercial solicitations or could constitute junk mail, pyramid schemes, chain letters, or any other commercial activities.
VI. adversely affects, inhibits or restricts any other user from using and enjoying the Services;
VII. contains any virus, cancel-bot, time bomb, Trojan horse, worm or other related harmful programming routines.
When you submit Contributor’s Content, you offer us a non-exclusive, worldwide, royalty free, irrevocable, perpetual licence to use it in any way or form as well as in any forum or medium, without any form of notice, payment or attribution to you or any third party and you waive, and agree not to implement any moral or related rights you may have in your Contributor’s Content.
Additional Rules
Forge Relations retains the right to post, at any time, additional terms that apply to certain areas of the Services. Such additional terms will be shown in the appropriate areas of the Services, and will be visibly identified. Your usage of those areas of the Services suggests your agreement to those additional terms.
Electronic Communications
You agree to receive communications from us by email based on these Terms and applicable law. You accept that all agreements, disclosures, notices and other communications that we offer to you electronically will be in line with any legal requirement that such communications be in written format.
Copyright Policy
All Content and other material on the Services are owned by Forge Relations or our third-party licensors (and are covered by international copyright, patent, design, trademark laws, and other laws protecting any intellectual property and related proprietary rights). All such rights are reserved to us and our licensors.
You acknowledge that Forge Relations and any other brands or logos that belong to us within the Services are the Forge Relations trademarks (the “Forge Relations Trademarks”) and that you may not use them without getting a written consent from Forge Relations.
You agree not to alter or remove any copyright, trademark, patent, or other proprietary rights notices showing on the Services.
Making unauthorized copies of Content available via or found on this Services may lead to the prohibition of your use of the Services and relevant further legal action.
Forge Relations has high regard for the intellectual property and other rights of others, and Forge Relations requests its users to do the same. Forge Relations may, in applicable circumstances and based on sole discretion, terminate the access of users who violate the rights of others.
If you notice or believe that your content or work has been copied and is accessible on the Services in a way that can be regarded as copyright infringement, or that the Services have links or other references to another website that has material or activity that violates your copyright, please contact us.
If you notice or believe that any user has defamed you on the website via his/her Contributor’s Content, please ensure you inform us.
Indemnification
You agree to indemnify, defend, and treat harmless Forge Relations and our officers, agents, employees, assigns, directors, successors, and affiliates from and against all damages, claims, losses, liabilities, actions, judgments, settlements, interest, penalties, awards, costs, fines, or expenses of any kind, including attorneys’ fees, resulting from your use or misuse of the Services, or your violation of these Terms, including with no kind of limitation to the content submitted or made available through the use of the Services.
Disclaimer of Warranty and Limitation of Liability
To the highest degree allowed by appropriate law, you expressly agree that your use of the Services is solely at your own risk. The Services are offered on an “as is” and “as available” basis for your use. To the degree allowed by relevant law, Forge Relations and its licensors, service providers, suppliers, vendors, and their respective agents, directors, officers, employees, members, sub-contractors, and representatives hereby expressly disclaim all kinds of warranties, express and implied, including any warranties of accuracy, reliability, non-infringement, title, merchantability, fitness for purpose or any other warranty, condition, guarantee, or representation, whether oral, written or in electronic form, including the completeness or correctness of any information therein or provided by the Services.
Forge Relations makes no representation or warranty that access to the Services will be uninterrupted or that there will be no error, omission, failure, or loss of conveyed information, or that no form of viruses will be transferred on the Services. Forge Relations offers no guarantee that you will be able to access or use the Services at the times or locations of your choice, or that Forge Relations will have sufficient capacity for the Services as a whole or in any particular geographic area.
In no event shall Forge Relations or its licensors, service providers, vendors, suppliers, and their respective agents, officers, directors, employees, members, sub-contractors, and representatives, be liable for indirect, direct, punitive, special, or consequential damages arising out of your usage of the Services, the internet or for any other claim related to your usage of the Services, including for viruses alleged to have been acquired from the Services, your usage of or dependence on the Services or any of the information or materials available on the Services, despite the claim or cause of action, even if we have been advised or warned of the possibility of such damages.
Forge Relations does not endorse or warrant any third-party products or services provided via the Services and will not be a party to or even be responsible for monitoring any transaction that occurs between you and third-party providers of products or/and services.
Because some jurisdictions don’t permit the exclusion or limitation of liability for incidental or consequential damages, in such jurisdictions, liability shall be limited to the fullest degree allowed by law.
Liability will not be limited in the event of personal injury or death directly caused by negligence, fraudulent misrepresentation, or any other liability to the level such liability cannot be excluded or limited as a matter of relevant law.

We reserve the right to change or update any of the events to submission guidelines at any time without notice.
We retain the right to terminate your use of or ability to access the Service at any time, for any reason, without any form of notice.

Shipping/Refunds/Returns
Tickets will be delivered electronically and all sales final.
